the cops decided 'not to investigate' hernandez. civil suit was just re-filed last week. they were in a strip club, but the victim made no statement to police and didn't press the issue criminally.

Heat of passion is a defense to murder. There isn't less evidence, just need to show that the defendant was provoked sufficiently and acted without time to cool off. If this can be shown then murder becomes voluntary manslaughter - a lesser charge then pre meditated murder.
