Now this is an issue my roommate and I discussed last night. Most states haven't really touched the issue yet, but if he's in a state that does not recognize gay marriage but does recognize that a person may change his or her gender, what does that do to his marriage once he transitions? Is he in a legal grey area where the state recognizes him as a man for marriage so as to not invalidate a marriage license they validly authorized while still recognizing her as a woman for everything else, or is it blanket woman, and if so what would they do to the marriage license?

I'm super interested by this question.

I would think that absent some sort of specific statutory directive on the issue, a court would be inclined to continue to recognize the marriage as valid. I am trying to think of how such a case would end up in the courts though . . . denial of state or federal spousal benefits or privileges? not sure that your garden variety defense of marriage conservative legal interest groups would have standing to challenge the validity of a preexisting marriage.
