i find the idea of posting people's pictures after being taken into custody and before being found guilty odd. but pictures being posted by the media aside, i'm just saying faxy and matt that there is a little bit more info here than your average drive by raping. there are witnesses, the woman interacted with the man before she was attacked and the guy was an employee at a music festival. her making up the story definitely isn't out of the question, but it's far less likely than the high school girl who was alone with her new boyfriend. none of us were there and will never really know "the truth", but the facts aren't really on his side here.
and i'd like to see some statistics on dna proving the rapist innocent years later. there are times where cities don't even have the funding to run tests on their rape kits. not to mention the number of cases that don't get reported (as in my own case) because it's such an uphill battle to get anyone to believe you and you feel guilty about your own choices.
we don't know whether he did it or not, but this story isn't exactly the poster child case for playing defense attorney. especially when you have a few board members in this thread who are sensitive to the subject and who are having emotional reactions to this issue.
I don't understand what has been said in this thread by me or Matt that was insensitive to anyone who is sensitive to the issue. I mean, I could see all the "you gonna get raped" posts eliciting that response but playing defense attorney is somehow insensitive?
If that's the case I apologize. I wasn't trying to make anyone cry or relive any nightmares that's for sure and I mean that sincerely.

I was in no way suggesting that rape victims are wrong more than they are right in terms of identifying their attacker. I just wanted to counter this claim:
I was suggesting that DNA is usually the factor that exonerates a person from a murder, rape etc.
Not that the victim usually makes a mistake in identifying their attacker.

Almost all of the exonerations – 97% – grew out of convictions for the two most serious
common crimes of violence:
(1) 199 murder cases (61% of all exonerations), including 73 innocent defendants
who were sentenced to death (22%); and
(2) 120 rape cases (37%).In 88% of the rape cases the exonerations were based on DNA evidence; 20% of the murder
exonerations involved DNA, almost all of them for homicides that also included a rape.
• The large number of rape exonerations is due to the unique power of DNA to detect false
convictions for rape. False convictions may well be at least as common for other crimes of
violence, especially robbery. If some error-detection technique comparable to DNA existed
for those crimes, exonerations for robbery and other crimes of violence would almost
certainly outnumber those for rape by a large margin.Almost 90% of the false convictions in the rape exonerations were based in large part on
eyewitness misidentifications. Cross-racial misidentification is a special danger. About 50%
of the exonerated rape defendants are black men who were misidentified by white victims,
but only 10% or less of all rapes involve black perpetrators and white victims. As a result,
black men are greatly over-represented among defendants who are falsely convicted and
exonerated for rape.

No, it is just hard for women (especially women who have experienced anything close to an attack like this) to see someone pick the side of the accused even if they haven't been found guilty. I know there are cases where the accused is innocent but there are more cases where the accused has gotten away with a horrible crime due to some technicality or other.
Tell me this, if someone was accused of rape, not convicted, just accused, would you allow your mother/girlfriend/child be alone with that person? Even if things came back as inconclusive would you still hold a slight bit of doubt in the back of your mind?
The thing is... I never once referenced the Stagecoach rape. I sure as hell didn't "pick a side."
I was just pointing out that there are instances where, in fact, the victim made a mistake in identifying their attacker.

pick a side wasn't really what I wanted to say but I am busy clicking between windows and got ahead of myself. I guess defending the defendents of rape cases in general, it is just hard to stomach for some. I know there are cases of women accusing someone out of spite, or being so traumatized that they pick the wrong person, but even if it came back and the man accused was found innocent I would still worry.

and thanks for those faxman factsone thing i'd point out there is homicides involving rape. in that case, it isn't the attacked person making the misidentification, but the witness.
it would be nice if there was a better way to handle these cases, as there are clear examples on both sides of justice not properly being served.
