Um well, to answer your question, yes. Tool is better live, and Tool makes generally better music and has a higher ratio of good to bad material than does NIN.

overall...tool is probably best. but when you take into account the last 4 years or so of tool vs what nin has done, nin probably is the best recently, mainly cause of maynards attitude and the uninspired setlists they've had recently.
now if you're asking what is better, Tool Lateralus tour or NIN LITS....that's a tough one. visually, i think LITS was better as well as the overall production. but the tool lateralus tour was SOLID. not as crazy of visuals as LITS, but their music/setlist selections that tour were perfect.
if i HAD to pick. i'd pick tool. but they only beat out NIN by a cunthair.

Tool would never play a whole album or play 38-40 song setlists.
It's no longer possible for Tool to play a whole album since Maynard cannot perform certain songs anymore (e.g. 20-second scream on The Grudge, Ticks and Leeches, or Eulogy).
As well, although some of NIN's song are long, not all of them are; whereas the songs that Tool performs now are typically much longer and have extended versions. 40 songs by Tool would equate to a 5 or 6 hour show...
More on duration of the show, 3 hours would pushit for Tool. There would have to be longer synth interludes between songs I suppose, or a 30 minute long intermission with ambience like the most recent tour.

Yes, in a way, but Tool expressly choose not to release material more often because they want to ensure that when they do release an album, it's actually good. At least Maynard has said that; I'm sure the other members would gladly put out albums every two years, but Maynard won't do it.
I'm not saying they're perfect. 10,000 days was pretty good but not great. However, NIN has released some pure shit at various times. I still love a lot of Trent's stuff but even the stuff I do like isn't as interesting as Tool to me.
I missed both Lateralus tour and LITS tour so I can't really speak to those live shows. But I saw NIN with Jane's Addiction and I've seen Tool four times, and each of those four times was much better than the NIN show.

that NIN show at Coachella was so fucking incredible. Looked like it was set on the Death Star with those blue LED lights going up and down. Doesn't it feel better to be at the complete mercy of the swaying crowd with no control over your own movements?
