En banc review normally means that the whole circuit gets to review the case. Because the Ninth is so goddamn large, they have created a special procedure where "en banc" review consists of the chief judge of the circuit and ten other judges randomly assigned to the case. Otherwise it would be impossible for meaningful review to occur.
