    Default Recommend An LA Lawyer

    Not for me, amazingly, but my roommate--I had to pick him up from a DUI arrest last night at 3 am. He talked to some guy whose ad he hears on the radio a lot today and the dude had a flat rate of 3000 which he wanted up front. My roomie doesn't have a whole lot of cash flying around naturally so I told him to shop around a little, look for somebody who (a) seems like they're really smart but also (b) would maybe only want a 1500 or 2000 retainer and an hourly rate, or just a lower flat fee.

    Any personal experiences, advice, names, numbers?

    It might very well be nowadays, but either way he should take advantage of the free consults from at least two or three of the bastards before settling on one. My recollection of lawyer's fees is based on the decade-old practices of my dad who was prone to undercharging, so I'm not really sure what the range is nowadays.

    is it even worth fighting, though? was he way over the limit? if so, what can a lawyer even do? if it's a first offense you might as well just take it, along with the fines/costs that come along with it.

    Breathalyzers can be beat in court and there might have been some Miranda issues. For whatever reason, they released him into my custody at a rest stop off the freeway--no bail or anything. Lawyers are good things to have sometimes.

    I been arrested multiple times for drug possession and I have never been read my rights. I doubt you will get very far with that. I had a roommate get 4 dui's and on the last one they suspended his license for a year. He had to spend a weekend in jail too. Not the county though. Your friend sounds like he's not really in any trouble. Especially since he was not arrested.

    If he wasn't arrested or booked for anything there is a huge chance that a good lawyer could easily get him off of the whole thing and save all of the stupid DUI shit you have to go through. However, I don't know of a single lawyer in town that would do it for $1,500-$2,000. My lawyer got me off on two DUI's (within 6 months) that I was arrested and booked for, each arrest I was twice the legal limit... He charges a pretty fucking penny though, I can try and get his info and pm it to you. I'm sure he wouldn't mind meeting with your friend.

    Going with the public defender is rolling the dice. You might get a good one. There is no money better spent on that which keeps your ass out of jail. Shop around. Find a specialist in criminal or dui law. Don't go with anyone you see on TV or on the back of the yellow pages. A lot of good lawyers will take payments.

    I don't know about that. Public defenders are wanting to be recognized by their peers, I think. They want to win. Speaking from experience, (A really bad lesson.) my attorney charged $10,000, only to screw shit up. I appealed that ruling using a court appointed appellate attorney and won my appeal. Granted, that took 2 years, but had I perhaps rolled the dice and gone with a court appointed attorney to begin with, I wouldn't have sat wasting 2 years over something that was fairly obvious from the start. Seems to me that a rest stop as opposed to being picked up from a drunk tank, says alot right there for the seriousness of this deal for your friend.

    He's not going to jail anyway. I never got a DUI but if it's anything like drug court he will have to take some kind of DUI classes and pay restitution. Maybe he will be on summery probation for awhile. If the guy has the money why not get a lawyer. I think in the end though you will end up having to pay the lawyer and the courts for something the public defender does for free everyday.

    DUI can have jail time depending on the level of alcohol in the system and the circumstances surrounding the stop and arrest. Also,they don't have to mirandize you for a DUI offense. I can't remember the reasoning behind that, but they do have a reason for it. Don't get the public defender. It's running a risk that your friend probably doesn't want to take. My brother has used the public defender every time he's had an alcohol related offense, and this time it might just bite him in the ass.

    dunno bout Calif but in Az there is no getting out of the jail time at all for DUI, even for a 1st offense (unless you manage to get a Not Guilty, of course). even if you get it pled down from DUI to reckless you're still looking at 24 hours in the tents.

    And a year of the breath alyzer in your car, and 3 months suspended license, just on first offense and that is if it isn't an extreme DUI.

    We need the jail space in LA for murders and gangbangers. He's not gonna do one second of time. I would be willing to bet regardless if he gets a lawyer or not he's going to be paying restitution and be on probation. LA county needs all the money it can get. Hey but get a lawyer it can't hurt.
