Actually, that's Comcast being proactive before the RIAA, or in your case the MPAA, finds out.

What exactly is that email even asking you to do? Delete that shit?

But if that happened to me I'd most likely move.

File off your fingerprints and change your name. Sell your family for 100 bucks and use it to hitchhike across the country. Get a dog with one eye and yell at traffic.

There really isn't any alternative.

03-06-2007, 06:46 PM
I got one of those before, but a suit never developed, which is not to say that it couldn't here. What it means is the RIAA people have requested your information (the information pertaining to the IP that downloaded some bait or file they were otherwise watching) from Comcast, and Comcast is letting you know that they had to comply, legally.

Courtney
03-06-2007, 06:46 PM
Yikes, scary. But for what it's worth, they can't prove that it was you who was downloading, only that it was your computer. For all they know, it could be your boyfriend/girlfriend/children/friends/housekeeper/etc downloading the illegal material.

It doesn't matter.

I read an article on RS about people being prosecuted. There was an ld great grandmother who didn't even know how to download music, yet someone did fro her machine, and action was taken against her. They don't give a fuck. They're out to prove a point.

For real though, even if they "can't prove it was you" and you argue that it was your boyfriend or dad or somethign, they can still sue you. And if they sue you, you have to hire a lawyer, and we are some expensive ass whores.

Do you know how expensive it is for them to sue you? I don't know the exact figure, but it's probably a lot more than they'd get out of you. corporations don't sue out of spite. You're not a big enough fish to prove a point with (unless maybe you are, are you? I won't tell anyone). In all likelyhood their goal is to get you to do exactly what you just did, scare people.

Okay, so I worked for a service provider where I had to field these calls. I've actually never seen anyone get caught for this on a Comcast network but.. this means you were caught downloading (more likely caught seeding) a movie and you're getting slapped on the hand. If they catch you (someone reports you) again, they might slap you on the hand.. again. Depending on their process, you have a number of warnings before they'll suspend (or cancel) your account. If I did anything, I would make sure whatever file you've downloaded is no longer in a shared folder.

I don't know if it's been answered, so I'll just ramble anyway.

The letter means that one of the watchdog groups for the RIAA, MPAA, etc. was monitoring the public torrent that you decided to sit on for a period of time.

That watchdog group recorded your IP and wrote a letter to your ISP with that information.

Your ISP is now sending you this letter telling you that your IP was caught and quit fucking around or we're going to cut you off ("may result in the suspension or termination of your Service account.")

That's it.

I suppose a claim of "someone else must have been spoofing my IP address" wouldn't fly?

He doesn't have to do anything right now. It's a warning letter.

If somehow he pisses off his ISP and they hand his information over to the watchdog group, they'll sue him.

Then, he'll have to talk to a lawyer and the lawyer will decide whether or not that is a valid claim.

IP Spoofing doesn't fool the ISP does it? I don't know.

These things cost money. And it wasn't a movie, it was The Office. It seems Comcast tends to be more aggressive in the case of TV shows, since they also sell cable, which i coincidentally don't buy. Coincidentally, meaning directly related because I can just download the shit.

hahahahah you used a public torrent site.
Private trackers are no safer than public ones. In fact, the private ones could end up screwing you worse in the end because if the RIAA/MPAA got access, those sites keep a complete history of everything you've d/l'd and u/l'd.

Either way, the letter he got was in reference to The Office. It was from NBC. NBC and HBO are the only networks I've heard of that are sending out warnings (or telling your ISP to warn you.) I haven't heard of any network suing anyone. All the suing has been done by the RIAA/MPAA over music and film, respectively. I think a lawsuit over a broadcast television show might be pretty easily thrown out, which is probably the only thing stopping the networks from suing people for d/l'ing shows. I mean, The Office is broadcast over the airwaves to anyone with an antennae, why shouldn't you be allowed to d/l'd it, aside from the commercials being cut out?

adamnikyo
03-07-2007, 12:16 PM
Tom, you can't steal pastry and then go buy bread to compensate for the pastry you stole when you realized the pastry was worth spending money on.

It's a physical object.

Not the same.

DeltaSigChi4
03-07-2007, 12:26 PM
They all cost something. Bread, pastry, producing that goddamn show. It all costs something. And someone is going to pay. If he steals, he's going to pay, by either getting prosecuted [and later pounded in the ass in prison], or by being sued [where he'll pay more than what it cost to buy the goddamn season], or both. Hopefully it's the latter in this particular case.

Ronnie, I'm sorry, but if you want to rob the CEO of my company and he decides to fuck me over because of it I'm not blaming you, I'm blaming him for being rich and greedy.

Yeah, Cody. Way to be a moron. Jesus didn't, like uhh, make infinite bread. It was probably just, um, a few loafs or somthing. Jeez, I'll bet you feel stupid now.

E

god damnit.....i'm sick and tired of your bullshit comments. why do you feel the need to provide advice when you have absoutely no idea what the fuck you're talking about???

no one has gone to jail for downloading copyrighted material.

now, if you try to illegally sell copyrighted material, that's an entirely different issue.

Idiots always show up after the lineup is announced... usually they go away. This year, for some reason, a high percentage of the idiots have decided to stick around a bit longer.

no need to worry, this happened to me, twice. HBO show Rome. they just turned off my internet service. i called them, they told me to delete the file and the bittorrent client, i told them i did already (lie), then they turned the service back on. same thing happened the second time, no legal action ever, it didn't really scare me away from downloading. however it did prompt me to start using mostly private trackers (try TVtorrents or Demonoid) and to start using PeerGaurdian2 which prevents this type of thing from happening.

keep downloading, but get PG2 and try to get membership to a private tracker because torrentspy and mininova are known to have those fake torrents that caused your warning.
