"Sex Beat" is such a great song. I remember virtually nothing else of that band however.

Zack convinced me that they may have been just about the best band of the 80s. You love X and the Blasters so I just figured they'd be another one that you listened to constantly. You should really give their debut, Fire of Love, another spin. It starts with Sex Beat and somehow it retains that sterling quality through the first half. Most of the second side is equally stunning.

LOS ANGELES — California appellate judges urged legislators to update an arcane 19th century law, as the panel reversed the rape conviction of a man who authorities say pretended to be a sleeping woman’s boyfriend before initiating intercourse.

The Los Angeles-based appeals court said that the 1872 measure doesn’t give single women the same protections as their married counterparts in certain rape cases.

Julio Morales had been convicted and sentenced to three years in state prison, found guilty of entering a woman’s bedroom late one night once her boyfriend had gone home and initiating sexual intercourse while she was asleep, after a night of drinking.

But a panel of judges overturned the trial court’s conviction and remanded it for retrial, in a decision posted this week.

The victim said her boyfriend was in the room when she fell asleep, and they’d decided against having sex that night because he didn’t have a condom and he had to be somewhere early the next day.

Morales pretended to be her boyfriend in the darkened room, and it wasn’t until a ray of light from outside the room flashed across his face that she realized he wasn’t her boyfriend, according to prosecutors.

“Has the man committed rape? Because of historical anomalies in the law and the statutory definition of rape, the answer is no, even though, if the woman had been married and the man had impersonated her husband, the answer would be yes,” Judge Thomas L. Willhite Jr. wrote in the court’s decision.

The appeals court added that prosecutors argued two theories, and it was unclear if the jury convicted Morales because the defendant tricked the victim or because sex with a sleeping person is defined as rape by law.

The court said the case should be retried to ensure the jury’s conviction is supported by the latter argument.

The decision also urges the Legislature to examine the law, which was first written in response to cases in England that concluded fraudulent impersonation to have sex wasn’t rape because the victim would consent, even if they were being tricked into thinking the perpetrator was their husband.

Willhite noted that the law has been applied inconsistently over the years in California.

In 2010, a similar law in Idaho prevented an unmarried woman from pressing rape charges after being tricked into sex with a stranger by her then-boyfriend.

The judge called what happened “despicable” but said the state’s law left the court with no choice. Idaho’s law was amended to cover all women in 2011.

Morales’ attorney Edward Schulman declined comment when reached by phone Thursday.

Prior to the conviction, Schulman had argued Morales believed the sex was consensual because the victim responded to his kisses and caresses, according to the decision.

The victim's version:

According to Jane, she woke up to the sensation of having sex. She was in a different position on the bed, perpendicular to the position she had been in when she fell asleep. She was confused because she and Victor had agreed not to have sex that night. When light coming through a crack in the bedroom door illuminated the face of the person having sex with her, i.e., defendant, she realized it was not Victor and tried to push him away. Defendant grabbed her thighs and pushed his penis back into her vagina. She pushed him away again and began to cry and yell. Defendant left her room; Jane locked her door and called Victor, asking him to come back to her house.

Morales' version:

He thought she was attractive, so he kissed her on the cheek. She turned toward him, and they kissed some more. He thought she was not asleep because she responded to his kisses, but he also thought she believed he was her boyfriend. They kissed for several minutes, and he became aroused. He began to take her pajamas and underwear off, and she lifted her hips to help him. He unbuckled his belt, pulled down his pants, and began to have sex. He stopped because he felt he was betraying his girlfriend; he did not recall Jane pushing him away, and he did not try to reinsert his penis after he pulled out of her.
When he went to leave the room, it felt like someone was holding the door shut. He finally was able to open the door, and he saw his friend Tony standing outside, laughing.

What bothers me most is that this isn't an isolated incident of one bad apple. These rosy-cheeked children clearly think this behavior is okay. At 16 years old, these boys aren't the only ones at fault. It's also the fault of the community in which they are being raised, and the culture which perpetuates the belief that women are physical bodies there for the taking. It's disgusting.

Almost six months ago now I began employment at a pretty big company. I've done, seen and learned more about my field in this time than I have over the last couple of years. The scale of projects pretty much equal what I dreamed to one day do, the money involved is like nothing I've ever seen. I get in to work early and I get home late, tired, hungry, and some days I'm just ready for bed immediately. But the best part about it all, is that I absolutely fucking LOVE IT! I'm gonna go eat now. This week has been viscous and I am pooped.

You can get off if the cops looked in the wrong car with the wrong warrant when they found your joint, but you have no recourse if owning the joint gets you locked up for life. I went to the hospital for the first time as an adult for being sick this morning. This is the 6th day I have had this outrageous flu. Six full days of a headache and I have never had one last longer than a couple hours. I haven't ate anything in three days. Just sipping on water, gatorades and a one a day smoothie. Coughing non stop, the nurse said I have bronchitis. My temp was 100.8. I am super dehydrated. I was confused and had loss of balance for three of the days. I'm sore head to toe. The nurse gave me a fucking perscription for an inhaler. Waste of time and money. "Let it run it's course, there's nothing we can do."

I've had bronchitis multiple times and while I did get an inhaler I never had any of those other symptoms you've described. It's always been nothing more then a painful dry cough. Maybe there are multiple type of bronchitis though. Either way that sucks I hope yo feel better real soon.

It's pretty impossible to overdose on vitamin C since it's water soluble and you piss all the excess out. If you DO somehow manage to accumulate huge amounts you can get indigestion and diarrhea but it's pretty uncommon and I think the amounts required for that are ridiculous and sustained over a long period of time. If you've got a handful of genetic disorders it can jack up your shit but those are very specific cases.

Ron, you do realize that the LOWER the pH the more acidic something is? That means lemons are the most acidic, then limes, then grapefruit, then tangerines. And since pH is a log scale lemons and limes are quite a bit more acidic than grapefruits and tangerines.

If you DO somehow manage to accumulate huge amounts you can get indigestion and diarrhea but it's pretty uncommon and I think the amounts required for that are ridiculous and sustained over a long period of time. There's 3 bedrooms (one with a movable wall), ONE bathroom, storage room, 2nd floor BBQ deck, and garage.

Yeah, I'd put a window or 3 on the first floor living area.

I'll go with what they just quoted on tv. "Find the good and praise it." That sounds so easy. It's too bad a lot of people don't follow the saying. It's sometimes easy to put down people, look at their mistakes, look for anything wrong that isn't perfect. Just go with the diametrically-opposed and look for the positive and good in people and situations. It's easy to be happy if you don't have to think about it. Just let it happen... See the thing is, Umberto Eco and Michel Foucault were buds, but Foucault's Pendulum was about the other Foucault, the scientist who used a pendulum to demonstrate that the earth rotates. Wikipedia says it was a joke, but I don't get it.

L'asile de vieillards est à Marengo, à quatre-vingts kilomètres d'Alger. Je prendrai l'autobus à deux heures et j'arriverai dans l'après-midi. Ainsi, je pourrai veiller et je rentrerai demain soir. J'ai demandé deux jours de congé à mon patron et il ne pouvait pas me les refuser avec une excuse pareille. Mais il n'avait pas l'air content. Je lui ai même dit : « Ce n'est pas de ma faute. » Il n'a pas répondu. J'ai pensé alors que je n'aurais pas dû lui dire cela. En somme, je n'avais pas à m'excuser. C'était plutôt à lui de me présenter ses con-doléances. Mais il le fera sans doute après-demain, quand il me verra en deuil. Pour le moment, c'est un peu comme si maman n'était pas morte. Après l'enterrement, au contraire, ce sera une affaire classée et tout aura revêtu une allure plus officielle.

J'ai pris l'autobus à deux heures. Il faisait très chaud. J'ai mangé au restaurant, chez Céleste, comme d'habitude. Ils avaient tous beau-coup de peine pour moi et Céleste m'a dit : « On n'a qu'une mère. » Quand je suis parti, ils m'ont accompagné à la porte. J'étais un peu étourdi parce qu'il a fallu que je monte chez Emmanuel pour lui em-prunter une cravate noire et un brassard. Il a perdu son oncle, il y a quelques mois.

J'ai couru pour ne pas manquer le départ. Cette hâte, cette course, c'est à cause de tout cela sans doute, ajouté aux cahots, à l'odeur d'essence, à la réverbération de la route et du ciel, que je me suis assoupi. J'ai dormi pendant presque tout le trajet. Et quand je me suis réveillé, j'étais tassé contre un militaire qui m'a souri et qui m'a demandé si je venais de loin. J'ai dit « oui » pour n'avoir plus à parler.

L'asile est à deux kilomètres du village. J'ai fait le chemin à pied. J'ai voulu voir maman tout de suite. Mais le concierge m'a dit qu'il fal-lait que je rencontre le directeur. Comme il était occupé, j'ai attendu un peu. Pendant tout ce temps, le concierge a parlé et ensuite, j'ai vu le directeur : il m'a reçu dans son bureau. C'était un petit vieux, avec la Légion d'honneur. Il m'a regardé de ses yeux clairs. Puis il m'a serré la main qu'il a gardée si longtemps que je ne savais trop comment la retirer. Il a consulté un dossier et m'a dit : « Mme Meursault est entrée ici il y a trois ans. Vous étiez son seul soutien. » J'ai cru qu'il me reprochait quelque chose et j'ai commencé à lui expliquer. Mais il m'a interrompu : « Vous n'avez pas à vous justifier, mon cher enfant. J'ai lu le dossier de votre mère. Vous ne pouviez subvenir à ses besoins. Il lui fallait une garde. The old folks' home is in Marengo, 45 kilometers from Algiers. I'll take the 2 o'clock bus and get there in the afternoon. Thus I will be able to watch and come home tomorrow night. I asked my boss for two days off and he couldnt' say no for a reason like this. But he didn't seem happy. I also told him, "It's not my fault." He didn't answer. I thought then that I didn't need to say anything more to him about it. In short, I didn't have to apologize. Instead he should have given me his condolences. He probably will tomorrow when I mourn. Right now it's almost like mother isn't even dead. After the burial, though, it will be a done deal and everything will look more official.
